LD8816152Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 3 of Title 11 a section numbered 11-71.1 as follows:
§ 11-71.1. Alternative dispute resolution.
Public bodies are authorized to enter into agreements to submit disputes
to [ arbitration and to utilize ] mediation and
other [ nonbinding ] alternative dispute resolution procedures
to resolve disputes. [ Nothing contained in this chapter shall be
construed to prevent a public body from entering into a written agreement to
submit any existing or future controversy to arbitration, mediation or other
alternative dispute resolution procedures, and no provision of an agreement
executed by a public body to submit disputes to arbitration, mediation or
other alternative dispute resolution procedures, whether such provision is in
force on or after July 1, 1995, shall be held invalid or unenforceable on the
grounds that the public body lacks the authority conferred by this
section. ]
