Be it enacted by the General Assembly of Virginia:

1. That § 19.2-295 of the Code of Virginia is amended and reenacted as follows:

§ 19.2-295. Ascertainment of punishment.

Within the limits prescribed by law, the term of confinement in the state correctional facility or in jail and the amount of fine, if any, of a person convicted of a criminal offense, shall be ascertained by the jury, or by the court in cases tried without a jury. Punishment ascertained by a jury shall be the maximum punishment pronounced by a court pursuant to § 19.2-298; however, the court may impose an additional term to be suspended in accordance with the provisions of § 19.2-295.2.
