Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 2 of Chapter 1 of Title 15.1 a section numbered 15.1-29.25 as follows:

§ 15.1-29.25. Counties, cities and towns authorized to exchange information.

A. Counties, cities and towns are authorized to exchange information with the Federal Bureau of Investigation pursuant to 28 U.S.C. § 534 (a)(4) and 28 C.F.R. § 0.85 (b) and (j), for the purpose of ascertaining the suitability of candidates for employment with the locality. However, the exercise of power granted herein shall be by ordinance duly adopted by the locality.

B. Any ordinance adopted by a locality under subsection A shall relate only to jobs with public safety implications and such connection shall be reflected in the body of the ordinance.

C. Localities which exercise the authority granted by this section shall at all times take appropriate precautions to ensure that information provided by the FBI is used solely for the purpose of determining a candidate’s suitability for employment. Localities shall also comply with all statutes and administrative regulations now or hereinafter enacted by the federal government regarding the handling and dissemination of such information.
