Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-308.2:3 as follows:

§ 18.2-308.2:3. Purchase of firearm from licensed dealer.

Any person purchasing from a dealer a firearm as defined in § 18.2-308.2:2 shall at the time of purchase (i) pay to the dealer a fee of fifty dollars to be disposed of by the dealer as otherwise provided in this section or (ii) furnish to the dealer proof of successful completion of one of the following:

1. A hunter education or hunter safety course approved by the Department of Game and Inland Fisheries or a similar agency of another state;

2. A firearms safety or training course sponsored by the National Rifle Association;

3. A firearms safety or training course or class available to the general public offered by a law-enforcement agency, junior college, college, or private or public institution or organization or firearms training school utilizing instructors certified by the National Rifle Association or the Department of Criminal Justice Services;

4. A law-enforcement firearms safety or training course or class offered for security guards, investigators, special deputies, or law enforcement or any division or subdivision of law enforcement or security enforcement;

5. Military service or participation in organized shooting competition; or

6. Possession of a valid license to carry a firearm issued by the Commonwealth or any locality thereof.

All money collected by a dealer pursuant to this section shall be promptly remitted to the Department of State Police for deposit by the Department with the State Treasurer. The funds paid to the state treasury shall be used to support state firearms safety education instructional and informational programs.

Any dealer who sells a firearm without obtaining the payment or proof required by this section shall be guilty of a Class 1 misdemeanor.
