Be it enacted by the General Assembly of Virginia:

1. That § 18.2-126 of the Code of Virginia is amended and reenacted as follows:

§ 18.2-126. Violation of sepulture; [ molestation defilement ] of a dead human body; penalty.

A. If a person unlawfully disinter or displace disinters or displaces a dead human body, or any part of a dead human body, which has been deposited in any vault, grave or other burial place, he shall be is guilty of a Class 4 felony.

B. If a person willfully and intentionally physically [ molests defiles ] a dead human body he is guilty of a Class 6 felony.

2. That the provisions of this act may result in a net increase in periods of imprisonment in state correctional facilities. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation is $ 0.
