Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-102.3 as follows:

§ 18.2-102.3. Newspaper theft; penalty.

It shall be unlawful for any person to knowingly or willfully obtain or exert unauthorized control over newspapers with the intent to prevent other persons from reading such newspapers.

A violation of this section shall be punished as a Class 2 misdemeanor. A second or subsequent violation shall be punished as a Class 1 misdemeanor.

For purposes of this section, "newspaper" means any periodical that is distributed on a complimentary or compensatory basis.
