LD9176396Whereas, on February 27, 1987, Yolanda Ghadban purchased a parcel of land, tax map reference number 99-3-[(1)]-40, at a Fairfax County escheat sale; and
Whereas, subsequent to such conveyance, by copy of a letter dated November 3, 1987, from the Director of the Real Estate Division of the Office of Assessments of Fairfax County, Ms. Ghadban became aware that the escheated parcel which she had purchased probably did not exist; and
Whereas, Ms. Ghadban proceeded to hire an attorney to look into the matter, and they determined by an examination of the land and tax records of Fairfax County, including an examination of title, that the escheated parcel did not, in fact, exist; and
Whereas, on November 18, 1988, Ms. Ghadban, through her attorney, submitted a claim for refund of her $5,000 payment for the land to the State Treasurer; and
Whereas, Yolanda Ghadban’s claim for a refund was denied on December 9, 1988, because discovery and submittal of the claim was made beyond the 120-day refund period allowed pursuant to § 55-200 A of the Code of Virginia; and
Whereas, Yolanda Ghadban has no other means to recover the expenses she incurred as a result of the improper escheat sale except by action of this body; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. § 1. That there is hereby appropriated from the general fund of the state treasury the sum of $5,000 less any expenses associated with the sale of the parcel. This payment shall be for the relief of Yolanda Ghadban to be paid by check issued by the State Treasurer on warrant of the Comptroller to Yolanda Ghadban, upon a release by her of all claims against the Commonwealth and its political subdivisions, agencies, instrumentalities, officers, or employees arising out of the aforesaid occurrence.
