A BILL to amend the Code of Virginia by adding a section numbered 46.2-809.1, relating to regulation of residential cut-through traffic by the Commonwealth Transportation [ Commissioner Board ] .

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-809.1 as follows:

§ 46.2-809.1. Regulation of residential cut-through traffic by Board.

The Commonwealth Transportation Board may develop a residential cut-through traffic policy and procedure for the control of residential cut-through traffic on designated secondary highways. Nothing in this section shall affect the validity of any city charter provision or city ordinance heretofore adopted.

For the purposes of this section, "residential cut-through traffic" means vehicular traffic passing through a residential area without stopping or without at least an origin or destination within the area.

The provisions of this section shall not apply in (i) cities, (ii) any town that maintains its own system of streets, and (iii) any county that owns, operates, and maintains its own system of highways.
