Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 14 of Title 10.1 an article numbered 3.4, consisting of sections numbered 10.1-1425.19 through 10.1-1425.22, as follows:

Article 3.4.
Directory Recycled Content Act.

§ 10.1-1425.19. Definitions.

As used in this article, unless the content requires a different meaning:

"Directory" means a telephone directory which is distributed in Virginia.

"Post-consumer material" means a material that having completed its life cycle as a consumer or manufacturing product would normally be disposed of as a solid waste.

"Recycled content" means the portion of a product's weight that is composed of recycled material, as determined by calculating the total recycled material input as a percentage of the total material input in the manufacture of a product.

"Recycled material" means any material that has completed its original end-use or product life and has been reprocessed so as to be used again in manufacturing the same kind of product or another product.

§ 10.1-1425.20. Post-consumer material content.

A directory shall have the following minimum amount of post-consumer material:

1. On and after July 1, 1996, twenty percent.

2. On and after July 1, 1998, forty percent.

§ 10.1-1425.21. Exemptions.

Directories shall be exempted from the provisions of this article in the following instances:

1. Recycled content paper is not available;

2. The recycled content paper is not of the same quality as paper made from virgin material; or

3. Recycled content paper is priced more than ten percent higher than comparable quality paper from virgin materials.

§ 10.1-1425.22. Certification of content.

A. The percentage of post-consumer paper content in each directory edition shall be certified by the publisher in a prominent location on each copy of the directory.

B. Upon request by the Department, a directory publisher shall provide evidence that the percentage of post-consumer recycled paper content in its directories is correct as certified in each directory edition. Each edition of a published directory shall be considered separately for the purpose of determining recycled paper content.
