FLOOR AMENDMENT (LAMBERT) AGREED TO BY THE SENATE

        shall not be required for:

        A. The relocation or renovation of a nonprofit hospital located in any city of not more than 210,000 or less than 180,000 if (i) the facility provides primary ear, eye, nose, throat, and other speciality services; (ii) the facility seeks to relocate within any city not less than 180,000 or more than 210,000; (iii) the facility decreases its number of licensed beds by more than fifty percent from its present approved number; (iv) construction on the new facility commences by July 1, 1998; and (v) the total capital expenditures for such facility shall not exceed $15,584,350.

        B. The construction of rehabilitation hospital when such project has been the subject of a certificate of public need application submitted to and accepted by the Department of Health within the last two years if (i) the total number of beds to be constructed does not exceed fifty-five beds; (ii) the facility will be located in a 500 to 525 square-mile jurisdiction in Planning District 8 which has areas designated as medically underserved in the Virginia Primary Care Association's 1994 Year in Review; (iii) the facility will serve employment centers with substantial numbers of employees performing medically high-risk jobs; (iv) the facility will offer outpatient occupational and rehabilitation therapy to disabled children and adults in the community; and (v) the facility has an educational component through a local university for the development of clinical training in nursing, physical therapy, or related rehabilitation services.
