(HB1747)GOVERNOR'S VETO EXPLANATION
Pursuant to § 6 of Article V of the Constitution of Virginia, I am vetoing House Bill 1747.
This legislation criminalizes the removal of free items based upon the state of mind of the actor. While I understand the underlying objective of this bill and do not regard that objective as unreasonable, the intent element of this new offense makes an otherwise problematic statute impractical and unenforceable. Under these circumstances, I think it would be very unwise to add this provision to the criminal code.
