SB 98 Affordable housing.

SUMMARY:
Affordable housing programs. Authorizes all localities (excluding Fairfax County which has its own affordable dwelling authorization) to amend their zoning ordinances to require developers of higher density residential projects to construct housing for low- and moderate-income households in exchange for an increase in the number of units permitted in the development. Currently, only 18 localities are so authorized. The bill also separates zoning law features from administrative law features; leaves zoning law features subject to advertising requirements, etc., of land use ordinances and the administrative law features subject to the advertising requirements, etc., for the adoption of regular county ordinances; much statutory material is repositioned with almost no changes from current statutory law. Same as House Bill 622.
