SUMMARY:

Constitutional amendment; powers of the General Assembly; retroactive application of certain laws; voter approval. Provides for a November 1994 referendum to approve the proposed amendment. The amendment authorizes the General Assembly to provide for the retroactive application of a change in the accrual date for civil actions involving intentional torts by natural persons against minors. The amendment overrides the Supreme Court's decision in Starnes v. Cayouette, 8 V.L.R. 3393 (1992), which disallowed a claim based on retroactive changes in the accrual date for claims involving childhood sexual abuse and held that the defendant had a constitutionally protected right once the statute of limitations had expired on the claim against him.
