SUMMARY:
HIV testing and release of test results for good Samaritans. Provides a mechanism for testing and disclosure of test results for good Samaritans who are exposed to the body fluids of the person they are helping in a manner which may, according to the then current guidelines of the Centers for Disease Control, transmit HIV or hepatitis B or C viruses. Such persons are deemed to be "health care providers" and include persons who render emergency care or assistance, without compensation and in good faith, at the scene of an accident, fire, or any life-threatening emergency, or en route therefrom to any hospital, medical clinic or doctor's office during the period while rendering such emergency care or assistance. The Department of Health will be responsible for providing appropriate counseling and face-to-face disclosure of the test results. This provision is a recommendation of the Joint Subcommittee on AIDS. This bill is identical to SB 395.
