SUMMARY:
Permits by default. Eliminates the permit by default provision in the Virginia Administrative Process Act with regard to the State Water Control Board and the Department of Environmental Quality to the extent necessary to comply with the federal Clean Water Act. Currently, in certain informal fact-finding proceedings after an informal proceeding has been held, an agency acting with or without hearing officer, is to reach a decision in 90 days. If a decision has not been rendered within that 90-day period, the applicant may notify the agency involved that a decision is due. If 30 days lapse from the time the agency receives such notice and the agency has not made a decision, the permit is deemed to be granted.
