SB 455 Registration of sexual offenders; adults and juveniles.

SUMMARY:

Registration of sexual offenders; adults and juveniles. Requires adults, and juveniles tried and convicted in the circuit courts, who have been convicted of specified felony sexual offenses on or after July 1, 1994, or on parole or supervision on that date for specified offenses committed before that date to be registered in a sexual offender registry maintained by the State Police. Persons convicted in other states of substantially similar offenses who move into Virginia are required to register within 30 days of establishing a residence here. All persons required to register must keep the registry up to date with any changes of address or change of name. Knowing failure to register or update the register and knowingly providing materially false information to the registry are punishable as a Class 1 misdemeanor.

Clerks are to make the report of conviction, with limited information on the offender and the offense, and any corrections which may thereafter be necessary to the registry within thirty days. The State Police are required to establish regulations governing expungement of records for individuals who have died, been pardoned or whose conviction is reversed. A person may petition the circuit court to have information expunged from the registry provided the offender is no longer a risk to public safety. Such information is to be removed, in any event, after 15 years from the offender's release from confinement or parole.

Sex Offender Registry information may only be disseminated, upon request, to authorized officers and employees of (i) a criminal justice agency, (ii) a public school division, (iii) a private, denominational or parochial school or (iv) a child welfare agency or a small family day-care home. Further dissemination for unauthorized purposes constitutes a Class 1 misdemeanor. A fee not to exceed $15 may be charged by the State Police for releasing information from the Registry.

This bill is recommended by the Commission to Reduce Sexual Assault.
