SUMMARY:

State Corporation Commission; Hazardous Liquid Pipeline Safety Act. Authorizes the State Corporation Commission (SCC) to implement the federal Hazardous Liquid Pipeline Safety Act. This 1979 federal act established a pipeline safety program under the administration of the Office of Pipeline Safety (OPS) within the U.S. Department of Transportation (DOT). The federal inspection can be delegated to state agencies if (i) such agencies have jurisdiction to do so under state law and (ii) the DOT (through OPS) approves and certifies a state inspection program.

This bill establishes the SCC's jurisdiction over pipeline safety as the first step in establishing an SCC-conducted safety inspection program. The next step is federal certification, and the bill expressly prohibits the SCC from asserting any inspection activity until such federal certification. The bill also prohibits localities from seeking (i) to exercise any safety inspection authority pursuant to this bill or (ii) reimbursement for any expenses incurred in monitoring inspections conducted by the SCC

The SCC's authority to conduct safety inspections of hazardous liquid pipelines will commence the 1st day of July next following the date the SCC receives its delegation of authority from the U.S. Secretary of Transportation.
