SUMMARY:

Air pollution control permit program fees. Delays the Air Pollution Control Board's authority to collect annual permit program fees until the U.S. Environmental Protection Agency has approved Virginia's operating permit program, or the governor determines that the fees are needed sooner in order to retain primacy over the program. Title V of the Clean Air Act Amendments of 1990 requires states to develop operating permit programs that meet certain minimum requirements, including the establishment of a permit fee system.
