SB 305 Transfer of juveniles; trial as adult.
Introduced by: Joseph B. Benedetti | all patrons ... notes | add to my profiles
SUMMARY:
Transfer of juveniles; trial as adult. Requires the court to conduct a hearing and transfer a case to the circuit court if it finds probable cause to believe that a child 13 or older committed a delinquent act which would be a felony if committed by an adult and which either resulted in the death or serious physical injury of another or involved the use or display of a firearm or other deadly weapon. Notice must still be given to the child's parents or other person standing in loco parentis and the court must find that the child is competent to stand trial. The law with respect to transfer of juveniles to the circuit court otherwise remains the same, i.e., if 15 or older and charged with any other "felony."
