SB 302 Stalking.

Introduced by: Edgar S. Robb | all patrons    ...    notes | add to my profiles

SUMMARY:

Stalking. Modifies the definition of stalking. A violation requires (i) repetitive conduct (ii) directed at another person (iii) intended or known to induce fear of death or injury to that person or to the person's spouse or child. The required intent to cause emotional distress language is deleted. Upon conviction, the court is required to issue a protective order or other order prohibiting contact between the victim and the defendant. The protective order statute is modified to eliminate the one year maximum term of a protective order issued following a stalking conviction.

Additionally, the bill clarifies that a prosecution may be brought in any jurisdiction where the conduct forming the basis for the conviction occurred.
