SUMMARY:
Certain program for persons living with AIDS. Authorizes the Department of Social Services to issue a license as an adult care residence to the Richmond AIDS Ministry's (RAM) guest houses. RAM has obtained group-home funding from the federal Department of Housing and Urban Development for construction of two eight-bed residences for end-stage disease patients. Although RAM has already been operating such a home, the present facility only has three beds and, therefore, is not required to be licensed. The new facilities, which already have a waiting list, must be licensed as adult care residences because they do not fit any other licensure description. However, present law controlling licensure of adult care residences prohibits care of patients requiring intravenous therapy or injections directly into the vein. Some of the residents in these homes will require intravenous therapy; therefore, the Department of Social Services must have special authorization from the General Assembly to license these facilities. RAM will continue to contract for intravenous therapy with a home health agency licensed by the Department of Health. This provision is a recommendation of the Joint Subcommittee Studying AIDS. This bill is identical to HB 1187, except that HB 1187 states that the facility shall be in compliance with all local zoning requirements.
