SUMMARY:

Accident and sickness insurance; exclusion of workers' compensation-covered medical condition; limitations. Limits the applicability of workers' compensation-related coverage exclusions within health insurance policies, health maintenance organizations' health care plans, and health care subscription plans issued by corporations. The bill bars the application of such exclusion whenever (i) the Workers' Compensation Commission issues an award denying compensation benefits for the medical condition in question and no application for further review is made, or (ii) an initial award is appealed to the full Commission, and the full Commission issues an award denying compensation benefits relating to the medical condition in question. The bill also states that once the application of this exclusion is effectively barred by the Workers' Compensation Commission's actions, then coverage for the medical condition in question must be provided immediately.
