SUMMARY:

Ox Activity Liability Act. Limits the liability of those who sponsor or conduct activities involving oxen such as rides, competitions and performances. Liability is not limited in those situations in which the ox activity sponsor (i) acts in a negligent manner, unless the injured party has expressly assumed the risk of injury as laid out in the statute; (ii) intentionally injures a participant; or (iii) knowingly provides faulty equipment which results in the injury. The expression of the assumption of risk includes the execution of a waiver giving notice of the inherent dangers of the activity including (i) the dangerous propensity of an ox, (ii) the inability to predict an ox's reaction to sounds, movements and the like, and (iii) hazards of surface or subsurface conditions.
