SB 138 Receivership of small water and sewer companies.

SUMMARY:

Receivership of small water and sewer companies. Authorizes the State Corporation Commission to appoint a receiver in those instances where a small water or sewer company is unable or unwilling to provide adequate service. The bill stipulates the conditions under which a receiver can be appointed. The Commission also is empowered to require restitution and impose up to a $500 civil penalty in instances of misappropriation or wrongful diversion of utility funds.
