HB 854 Determination of parent-child relationships.

Introduced by: W. Tayloe Murphy, Jr. | all patrons    ...    notes | add to my profiles

SUMMARY:

Determination of parent-child relationships. Clarifies parent-child relationships by specifically noting that a child born more than ten months after the death of a parent will not be recognized as such parent's child for the purposes of probate law exemptions, allowances, or other protections for children in a parent's estate, or in determining eligibility of the child or its descendants to share in a donative transfer from any person as an individual or a member of a class determined by reference to the relationship. Further, language inserted to overrule the Welborn v. Doe case (1990) which related to adoption of a child born through artificial insemination has been deleted (see § 32.1-257 D and § 64.1-7.1) and appropriate references to Title 20 statutes inserted.
