SUMMARY:

Accident and sickness insurance; pharmacies and ancillary service providers; freedom of choice. Requires preferred provider organizations (PPOs) and health maintenance organizations (HMOs) to permit individuals receiving pharmacy or ancillary medical service benefits under health insurance policies or health care plans to select, without limitation, the pharmacy or ancillary service providers of their choice to furnish such benefits. This right of selection also extends to and includes pharmacies or ancillary service providers that (i) are not preferred or participating providers under any such policies or plans and (ii) agree to accept reimbursement for their services at rates applicable to pharmacy or ancillary service providers that are preferred or participating providers. The bill also prohibits (i) reduced or disparate coverage or (ii) the imposition of monetary penalties if individuals receive such benefits from nonpreferred or nonparticipating providers. Ancillary services include the furnishing of medical equipment required for therapeutic and life-support purposes. The State Corporation Commission is declared to have no jurisdiction over controversies arising out of issues related to the right of selection established by this bill.
