SUMMARY:

Public procurement; prequalification of contractors for public construction. Establishes uniformity in the procurement process and forms used by public bodies if they use a prequalification procedure as part of their construction procurement. The bill establishes criteria on which the prequalification decision is to made and ensures that the requirement a contractor have sufficient financial ability to complete the contract is satisfied if the contractor can provide appropriate bonding for such project. The bill also creates an exception to the Freedom on Information Act for trade secrets or proprietary information provided by a contractor who has submitted an application for prequalification to bid on public construction projects.
