SUMMARY:
Fiduciaries; environmental liability. Creates a single section delineating the environmental liability of fiduciaries individually and transfers provisions of current law relating to the extent of that liability from the statute which specifies the powers granted to fiduciaries which may be incorporated by reference into a will or trust instrument. The bill provides a specific exception to the imposition of liability to ensure that a fiduciary is not held personally liable as an owner simply because he holds title to the property or as an operator because he may control the property. No change is made to the law governing the fiduciary's liability in his representative capacity.
