SUMMARY:

Employment; use of polygraphs in certain situations. Makes it unlawful for any law-enforcement agency to require employees to submit to a lie detector test or to discriminate against them for failure to do so. The bill provides, however, that the chief executive officer of a law-enforcement agency may, by written directive, require an employee to submit to a lie detector test related to a particular internal administrative investigation concerning allegations of misconduct or criminal activity. Under the bill, persons who believe that they have been discharged, demoted or otherwise discriminated against by any person in violation of this section may, within ninety days after such alleged violation occurs, file a complaint with the Commissioner of Labor and Industry who may order, in the event of discharge or demotion, reinstatement of such person to his former position with back pay plus interest.
