SUMMARY:

Animal remedies. Revises the Virginia Animal Remedies Law which has not been updated since 1956. The bill will ensure that any product intended for use in the diagnosis, cure, mitigation, treatment or prevention of disease in animals is properly labeled. The type of products affected by the law are those which are available without prescriptions including liniments, aquarium treatments and antibiotics. The bill exempts from the registration requirements medicated feeds which are already regulated by the Commercial Feed Law. The bill gives the Board of Agriculture and Consumer Services the authority to promulgate regulations needed to carry out the provisions of the law. The inspection fee is increased from $20 to $50 for each animal remedy registered. The Commissioner is authorized to assess a fee against persons who commit a prohibited act. The assessment can be ten percent of the retail price of the animal remedy or $50, whichever is greater, not to exceed $5,000. A 15-day grace period is allowed for the registration of an animal remedy; after which, the Commissioner, or his agent, may issue a stop sale, use, removal or seizure order until the remedy is registered. To ensure the viability of the program, charges and fees assessed by the agency would no longer be placed in the general fund but would be used to administer and enforce the program.
