SUMMARY:

Uniform Statewide Building Code; enforcement by localities; penalty. Authorizes a locality to assess a civil penalty for violations of the Building Code if the locality has adopted an ordinance establishing a uniform schedule of civil penalties. The bill provides that a civil action for a violation of the Building Code may be brought by the locality wherein the land upon which the structure is located lies. In any trial for a scheduled violation, the locality bears the burden to show the liability of the violator by a preponderance of the evidence. Further, the bill provides that an admission of liability or finding of liability shall not be a criminal conviction for any purpose. Finally, the violator must abate the violation within six months of the assessment of the civil penalty.
