SUMMARY:

Aboveground storage tanks. Exempts certain aboveground storage tanks (ASTs) from various pollution prevention regulations and procedures. Facilities not engaged in the resale of oil and aboveground tanks that (i) are totally off ground, (ii) have a capacity of 5,000 gallons or less which are located within a building or structure designed to contain a discharge, or (iii) contain No. 5 or No. 6 fuel oil used on the premises, would not be subject to any inventory control and inventory testing requirements. The Board is required, under this legislation, to establish criteria for granting variances from these requirements. The variances could be granted on a case-by-case basis or to those ASTs (i) with release prevention barriers with all piping off ground, (ii) containing no more than 12,000 gallons, or (iii) located within a building. Variances could not be granted if they present an unreasonable risk to public health or the environment. The bill exempts from all pollution prevention regulations ASTs with a capacity of 5,000 gallons or less containing heating oil used on the premises. Facilities that are not involved in the resale of oil from ASTs would not be subject to pollution prevention regulations until July 1, 1995 or a later date specified by the State Water Control Board. The bill contains an emergency clause.
