HB 628 Admission of expelled students.

SUMMARY:

Admission of expelled students. Provides local school boards the authority to exclude from attendance those students who have been expelled by another school division or private school in Virginia or another state for violations of school board policies related to destruction of school property or privately owned property while located on school property. Present law allows school boards to exclude such students for violations of school board policies related to weapons, alcohol or drugs, or for the willful infliction of injury to another person. This provision also allows school board exclusion of such expelled students regardless of whether another school division or private school in Virginia or another state has admitted the student subsequent to the expulsion. Pursuant to present law, the exclusion period may not exceed one school year (180 teaching days) and must be based upon a finding that the student presents a danger to the other students or staff of the school division; a notice, hearing, and appeals procedure are required by law to ensure due process protections for the student's right to a public elementary and secondary public education. The student may petition the school board for readmission upon the expiration of the exclusion period. Section 22.1-277.2 was enacted as one of the recommendations of the legislative subcommittee on school violence in 1993.
