SUMMARY:

Asphalt storage tanks. Exempts aboveground asphalt storage tanks from having to comply with (i) the pollution prevention regulations and (ii) the requirements for demonstrating financial responsibility for any discharge of oil. While such facilities would have to develop a discharge contingency plan, the plan would not have to include the installation of monitoring wells, ground water protection devices, or ground water characterization studies. Asphalt facilities would still be required to report discharges of asphalt on state lands, and in storm drains or waters and will continue to be liable for any damages resulting from a discharge.
