SUMMARY:

Attempted second degree murder. Corrects deficiency which came to light following last year's amendment to second degree murder punishment provisions. The maximum penalty for second degree murder was raised from 20 to 40 years. Punishment for attempted crimes is driven by the punishment for the completed crime and there was no parallel punishment provision for a term of 40 years for the completed crime. Thus, there was no specified punishment for attempted second degree murder.

As drafted, the punishment will cover not only second degree murder, but any felony where the maximum authorized punishment exceeds 20 years (e.g., drug kingpin violations).
