SUMMARY:

Rape. Overrules a 1898 Virginia Supreme Court case, Foster v. Commonwealth, which created an irrebuttable presumption that a child under the age of fourteen is incapable of committing rape. The bill establishes a rebuttable presumption that a juvenile, between the ages of 10 and 14, is physically incapable of rape.
