SUMMARY:

Motor vehicle dealers. Requires that, when so requested in writing by their franchised dealers, manufacturers disclose to the dealer the basis upon which new motor vehicles are allocated, scheduled, and delivered to the dealers of the same line-make. If allocation is at issue in a request for a hearing, the DMV Commissioner would be required to direct the manufacturer or distributor to provide to the dealer, within 30 days, all records of sales and distribution of all motor vehicles to the same line-make dealers who compete with the dealer requesting the hearing. The bill prohibits provisions in franchise agreements that would require motor vehicle dealers to pay the attorney's fees of a manufacturer or distributor.
