SUMMARY:

Storage facilities. Clarifies the financial responsibility requirements for owners of aboveground storage facilities. For owners of multiple facilities with annual net profits of $10 million or less, financial responsibility for the costs of containment and cleanup would be based on the storage capacity for the facility from which the discharge occurs, rather than on all of the owner's facilities. This will result in an owner being able to access the Virginia Petroleum Storage Tank Fund at a lower level, thereby allowing him to recover from the Fund a higher proportion of the costs of containment and cleanup. However, the requirement to demonstrate financial responsibility (five cents per gallon) would be based on the aggregate capacity of an owner's facilities within Virginia. This means that an owner would only have to make one demonstration of financial responsibility for all of his facilities.
