SUMMARY:
Transfer of student scholastic records. Eliminates the separation of Category I and Category II records within student scholastic records and clarifies that student scholastic records include materials related to educational development as well as disciplinary records, test data, health records, and assessments for eligibility for special education. This measure clarifies that these records specifically do not include records of instructional, supervisory, administrative, or ancillary educational personnel kept in sole possession of the maker. By removing the distinction between Category I and II records, the measure clarifies that all scholastic records are confidential and that disclosure is subject to state and federal laws and regulations, including the federal Family Education Rights and Privacy Act.
