SUMMARY:

Permits for confined animal feeding operations. Establishes the criteria for a general permit pertaining to confined animal feeding operations with 300 or more animal units. The State Water Control Board will adopt the general permit. A qualifying operation will be covered by the general permit upon submitting a (i) registration statement, (ii) letter from the Department of Conservation and Recreation showing approval of the operation's nutrient management plan, (iii) notice from the locality stating that the operations complies with land use ordinances, and (iv) certification that the owner or operator meets all the requirements of the general permit. To qualify for coverage under the general permit, the design and operation of the confined animal feeding operation must meet eight specified criteria. The general permit procedure is an alternative to current Virginia Pollution Abatement permitting procedure. The measure also extends the terms of VPA permits for confined animal feeding operations from five to ten years.
