SUMMARY:

Workers' Compensation; failure to pay compensation when due. Modifies provisions in the Workers' Compensation Act concerning late-payment penalties. Current law adds a 20 percent penalty to compensation payments not made within two weeks of their due dates. This bill modifies this provision to suspend the operation of the penalty provision during two, distinct periods: (i) during the interval between the initial compensation award and the date on which review by the full Commission may be requested (currently 20 days) and (ii) during the interval between the award of the full Commission following its review and the date by which a notice of appeal to the Court of Appeals may be filed with the Commission (currently 30 days). As a point of general information, an employer's obligation to pay an award of compensation is suspended (i) while it is being reviewed by the full Commission and (ii) while it is being reviewed by the Court of Appeals.
