SUMMARY:

Permits for existing ground water withdrawals. Allows political subdivisions, public service authorities serving political subdivisions and community waterworks, in the Eastern Virginia or Eastern Shore Groundwater Management Areas, to obtain ground water withdrawal permits based on the total amount of ground water withdrawn in any consecutive 12 months in the 12-year period between July 1, 1980, and June 30, 1992. Currently, ground water withdrawal permits for these areas are issued based on the total withdrawal during any consecutive 12 months in the five-year period between July 1, 1987, and June 30, 1992. Existing law allows for the issuance of permits for greater amounts of water than that based upon this five-year period following review by the State Water Control Board of a number of factors including the adoption and implementation, by the applicant, of a water conservation and management plan. The longer period created by this bill allows political subdivisions, public service authorities serving political subdivisions and community waterworks in the affected ground water management areas to obtain permits for greater amounts of water without this analysis.

In addition, the Board is directed to utilize the average historical withdrawals from surface and ground water conjunctive use systems in the Eastern Virginia or Eastern Shore Groundwater Management Areas when determining the availability of ground water when reviewing applications for new or expanded ground water withdrawal permits.
