HB 1251 Pollution prevention program.

SUMMARY:

Pollution prevention program. Requires the Department of Environmental Quality to seek to ensure, where appropriate, that inspections conducted under the water pollution, air pollution, and waste management programs are multimedia in approach, and minimize duplication of reporting requirements, inspections, and enforcement efforts. Where appropriate, environmental inspections may be performed by teams of inspectors representing these three programs. Persons violating environmental laws may be allowed to develop a plan to reduce the use or generation of toxic, hazardous substances through pollution prevention activities. The violator will be required to implement the plan, to the maximum extent possible, in order to return to compliance with the violated environmental program. Pollution prevention activities which the Department may implement are listed. In order to be eligible for any on-site technical assistance, the recipient must agree to share the results of the assistance with the public, subject to confidentiality and trade-secret protections. This measure is a recommendation of the Joint Subcommittee Studying Pollution Prevention (SJR 207, 1993).
