SUMMARY:

State/Local Hospitalization Program. Revises the methodology for determining eligibility for the State/Local Hospitalization (SLH) Program--a safety net program for indigent persons who are not eligible for Medicaid. Currently, eligibility for SLH is determined by the same method used to determine eligibility for the Aid to Dependent Children program. Because ADC is an income supplement calculated on a monthly income basis, using ADC methodology for SLH eligibility can result and has resulted in SLH eligibility for nonindigent individuals. Pursuant to a second enactment clause, the regulations in effect on January 1, 1994, (and, therefore, the current methodology) will continue to be used until amended regulations become effective. The enactment clause, although not codified, will be enforceable law and will provide the Board of Medical Assistance Services with time to develop and process the new methodology through the Administrative Process Act.
