SUMMARY:
Recovery of overpayment of Medicaid. Eliminates certain difficulties in recovering Medicaid overpayment from providers by authorizing the Director not to enter into agreements with providers that have terminated participation and then apply for participation as another entity without such provider making satisfactory arrangements to repay outstanding Medicaid overpayments incurred under the previous agreement. The term "stockholder," is clarified by the addition of "possessing a material financial interest." The Department has experienced problems with recovering overpayments from providers who have terminated an agreement to provide services as one entity and requested an agreement to provide services as another entity without giving assurances of repayment of the amounts due.
