SUMMARY:

Certificate of public need. Provides an exception to the moratorium on nursing facility construction for an association created in connection with a real estate cooperative for which an application for registration was filed prior to January 1, 1994, when the level of care to be provided to residents will comply with the definition of continuing care in § 38.2-4900. The provision applies only to Virginia Beach and there are limits on the number of new beds, the beds must be necessary to provide nursing care to present or prospective residents of the cooperative units, the association must agree not to apply for Medicaid certification, only residents of cooperative units will be admitted after the first three years of operation as a nursing facility, and the association complies with the disclosure requirements for continuing care providers.
