SUMMARY:
Habitual offender. Clarifies the section enacted last year imposing varying penalties on an habitual offender who drives depending on whether the driving endangered the life, limb or property of another. Driving which endangers life, limb or property in defined to include DUI driving, driving after being disqualified as a commercial driver, reckless driving, failure to stop and driving which results in manslaughter or malicious bodily injury. The bill also increases the penalty for driving by an habitual offender which does not endanger life, limb or property from a maximum of 90 days to a maximum 12 months in jail.
