HB 1051 Disposition of companion animals.

SUMMARY:

Disposition of certain companion animals. Allows local governments to require that feral dogs and feral cats which exhibit behavior that poses a risk of physical injury to a person confining the animals be held in a pound for at least three days before they may be euthanized. One of the three days must be a full business day. This bill applies to feral dogs and feral cats which do not bear a collar, tag, tattoo, or other form of identification. A disinterested person is required to certify in writing that these requirements have been met before an animal control officer can euthanize an impounded feral dog or cat. A pound may also provide for the immediate euthanization or other disposition of an animal delivered to the shelter by its rightful owner, if he surrenders his property rights in the animal and acknowledges that the animal may be disposed of immediately. Currently, all impounded animals must be kept for at least five days unless sooner claimed by the owner. This measure also allows animals to be adopted by residents of a city or county adjoining the locality operating the pound. This section does not apply to agricultural animals.
