Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 13 of Title 10.1 a section numbered 10.1-1322.3 as follows:

§ 10.1-1322.3. Permit modifications for alternative fuels or raw materials.

Unless required by the federal government, no additional permit or permit modifications shall be required by the Board, for the use, by any source, of an alternative fuel or raw material, if the owner demonstrates to the Board that as a result of trial burns at their facility or other facilities or other sufficient data that the emissions resulting from the use of the alternative fuel or raw material supply are decreased.
