Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 32.1-126.3 and 54.1-2400.1 as follows:

§ 32.1-126.3. Hospital licensure conditioned on certain discounts.

As provided in the Board of Health's regulations for licensure of providers promulgated pursuant to § 32.1-127, the issuance or renewal of every Board licensed health care provider shall be conditioned upon the offering, by such provider, to all its cash-paying patients, whether being served in an outpatient or inpatient capacity, of a discount representing the most favored rate such provider has agreed to accept as reimbursement with any third-party payor during the current fiscal year.

§ 54.1-2400.1. Licensure, registration, or certification conditioned on certain discounts.

As provided in the Board of Health Profession's regulations promulgated pursuant to §54.1-2400.1, the issuance or renewal of every regulated health care practitioner's license, registration, or certification shall be conditioned upon the offering, by such health care practitioner, to all such practitioner's cash-paying patients, whether being served in an outpatient or inpatient capacity, of a discount representing the most favored rate such health care practitioner has agreed to accept as reimbursement with any third-party payor during the current fiscal year.
